Research Area 4: The Formation of Legal Norms between Nations
Normative orders emerge beyond the nation-states. They arise, on the one hand, at the ‘international’ level, thus between states as a consequence of international politics, and, on the other, on a ‘transnational ‘level, i.e. between private persons, or between private persons and states, as a result of social processes. The guiding theme of this research area is the interpenetration of these two normative orders. It includes the consequences of social processes of norm production at the international level and the interrelations between norms within states and international and transnational norms, both of which can be understood in very general terms as the detaching of normative contents from their territorial confines and cultural contexts. In the process normative contents regarded as universal continually run up against particular normative layers. The understanding of the relations between the two categories is rendered more difficult by the fact that conceptions of what is universal and what particular can diverge.
