Gegenstand des Workshops sind zwei zusammenhängende Themenkomplexe: Zum einen geht es um die Frage, ob und wie genau mit der Globalisierung des öffentlichen Rechts das emanzipatorische Potenzial der konstitutionellen Tradition zur Entfaltung gebracht wird oder ob im Gegenteil konstitutionalistische Rhetorik lediglich neue Formen der Repression legitimiert bzw. den Fortbestand alter Repressionen verdeckt. Zum anderen geht es um die Frage: Kann eine von universalen konstitutionalistischen Prinzipien kritisch angeleitete Rechtswissenschaft als eine dem positiven Recht inhärierende Reflexivität verstanden werden und damit die Rolle einer kritischen Theorie des Rechts spielen?
