Abstract: The concept of the Estado de Derecho plays a central role in Argentina's process of political and legal legitimization. Its inflationary use defies the capacity of any given concrete conceptualization, as the dogmatic definitions sought to accomplish. By means of a historical-conceptual analysis, this essay seeks to reconstruct the formation of this concept within constitutional language from its critical reception in the 1930s, its formalization in the 1960s, and its progressive expansion from the 1980s onwards. Because of its role as a constitutional leitmotif, this analysis allows us to observe the relations between law and politics, the different uses of the concept by jurists over the years, and, as a consequence of these applications, the resulting formation of different layers of meaning that shape its particular semantics within the context of Argentinean public law.
