Research topic

Elements for the Conceptual Foundation of a General Theory of Public Law in a Multilevel Setting

Brief description of research topic

Law is going through a profound change which can be properly understood only by reshaping the categories of interpretation. Complex phenomena – like the arising of global governance beyond national borders, the increasing centrality of international organization and continental integration processes – challenge the interpretative capacity of the traditional public law which, up to the present, largely relies on the strict distinction between national and international domains, as well as on the separation from private law. As a contribution to the development of a conceptually sound and practically useful framework for the interpretation of the most significant trends of contemporary law, the research aims at sketching an interdisciplinary theory of public law in which supra-state, international, transnational, supranational and national public law are regarded – beyond the boundaries of the classic disciplines of the law – as parts of a synthetic construction in theoretical as well as in doctrinal sense. The so conceived general theory of public law in a multilevel setting grounds its inclusive character on a specific “paradigm of social order”. On this basis the fundamental elements of legal theory – in particular the concept of the law, the legal systematics with specific reference to the distinction between public and private law, the hierarchy of norms, the normativity and legitimacy of the law – are analyzed and re-interpreted in the light of a multilevel understanding of the legal system.
